Delhi High Court Directs CBSE To Allow Girl With Short Attendance To Appear In Board Exam

NEW DELHI:  The Delhi High Court, yesterday stayed the debarment by CBSE of a girl from appearing in class XII board exams. The girl had already written two tests conducted till now and had requested permission to appear in the remaining board exams. Justice Manmohan granted the girl interim relief to the Delhi-based girl who was short on attendance due to medical reasons. CBSE had earlier allowed the girl to appear in the exam but then debarred her from appearing in remaining exams by passing an order on March 24. According to Press Trust of India reports, the court said, "Since one of the papers in which the girl is to appear is scheduled for tomorrow, this court till further orders stays the impugned order dated March 24 issued by the CBSE and the letter dated March 27 passed by the school."

The court also directed that the girl's result should not be declared and kept in a sealed cover. The court also said that the present order should not create any equities in favor of the girl and should stick by the outcome of the writ petition.

Advocate Sakket Sikri, who represented the minor girl said that the girl had already appeared for two exams since CBSE had decided to accept her shortage of attendance on medical grounds and now it cannot prevent her from appearing in rest of the exams midway and without any prior notice.
